Beta User Agreement

This Beta User Agreement (this “Agreement”) applies to organisations and individuals invited to use pre-release or beta versions of the Arkavio Service (“you”, “Beta User”). It is additional to, and incorporates, the Terms of Service, the Privacy Policy and the Data Processing Agreement. Where this Agreement conflicts with the Terms for the beta period, this Agreement prevails.

1. Purpose and beta period

1.1 The beta gives you early access to Arkavio in exchange for using it in earnest and giving us honest feedback. The aim is to find problems and improve the product before general availability.

1.2 The beta period runs until we notify you that it has ended. We may start, pause, extend or end the beta at any time.

2. Pre-release Service — “as is”, no guarantees

2.1 The beta Service is pre-release and provided “as is” and “as available”. It may contain bugs, change without notice, behave unexpectedly, or be unavailable.

2.2 No service levels apply. There is no uptime commitment during the beta.

2.3 Possible data loss. While we take reasonable care and maintain backups, you should not rely on the beta as your only system of record for critical data during the beta period. Keep your own copies of important information.

2.4 To the fullest extent permitted by law, our liability during the beta is limited as set out in the Terms of Service, and we give no warranties beyond those that cannot be excluded by law.

3. Feedback

3.1 We will ask for your feedback, and may contact you for short calls or surveys.

3.2 You grant Arkavio a perpetual, irrevocable, royalty-free licence to use any feedback you provide (reports, suggestions, ideas) to operate and improve the Service, with no obligation or payment to you.

4. Confidentiality of pre-release features

The beta may include features, designs and information that are not public. Please keep non-public features and any information we mark as confidential confidential, and do not publish screenshots of unreleased features without our agreement.

5. Data handling during the beta

5.1 Your use of the Service during the beta is covered by the Privacy Policy and, for data you upload about your clients and staff, the Data Processing Agreement.

5.2 Session replay. Beta organisations may be enrolled in input-masked, anonymised session replay to help us diagnose issues. Optional analytics and replay remain subject to consent as described in the Cookie Policy, and you can manage your choices at any time.

6. Pricing after the beta

6.1 The beta itself is provided free of charge unless we agree otherwise in writing.

6.2 When the beta ends, continued use of Arkavio requires a paid subscription (or an active free trial) under the Terms of Service. We will tell you, before the beta ends, what you will pay and when, and how to subscribe. You are under no obligation to continue.

7. Term and termination

Either party may end your participation in the beta at any time. On the end of your participation, your access to the beta Service ends; data handling on termination follows the Terms of Service and the DPA.

8. General

This Agreement is governed by the laws of England and Wales. Except as stated here, the Terms of Service apply in full. Contact: info@arkavio.com.
